Terms and conditions

These terms are an agreement between you (the gym, studio or business that signs up, called "you") and Bandhutva Enterprises (Proprietor: Shailesh Appaji Sawant) ("we", "us"), which provides the Gymkar software: the web admin panel, the member app and the related services. By creating an account or using the service you accept these terms.
1. The service
Gymkar helps you run a fitness business: members, memberships, invoices, payments, attendance, workout plans, leads and messaging. The features available to you depend on the plan you choose, as shown on our pricing section and in your admin panel.
2. Your account
You must give true details when you sign up and keep them up to date. You are responsible for every login you create for your staff, for keeping passwords private, and for what happens in your account. Tell us at once if you think your account has been misused.
3. Free trial
New gyms get a free trial of the length shown when they sign up. No payment is taken during the trial. When the trial ends you can choose a paid plan; if you do not, your account becomes read-only and your data is kept.
4. Subscriptions and payment
- Plans are billed monthly or yearly, in advance. Prices are in Indian rupees and exclude GST, which is added at the applicable rate.
- Payments are collected through our payment partner, Razorpay. When you choose a plan you authorise a recurring payment (a card, UPI AutoPay or bank mandate), and each renewal is charged automatically at the start of the next billing period until you cancel.
- We send a tax invoice for every payment.
- If a renewal payment fails, you keep full access for a short grace period while it is retried. If it still is not paid, your account becomes read-only until payment is made. Nothing is deleted.
- We may change plan prices with at least 30 days' notice by email. The new price applies from your next renewal after the notice period.
5. Cancellation
You can cancel auto-renewal at any time from Settings → Subscription in your admin panel, or by writing to us. Your plan stays active until the end of the period you have paid for and is not renewed after that. Refunds are covered by our refund and cancellation policy.
6. Your data
You own the data you put into Gymkar, including your members' details. You decide what is recorded and you are responsible for having your members' consent where the law requires it. We process that data only to provide the service to you, keep each gym's data separate, and do not sell it. Our staff open your data only through a support session that records a reason, is time-limited and is shown in your audit log. You can ask for a copy of your data or for its deletion after you stop using the service; see our privacy page.
7. Acceptable use
Do not use the service for anything unlawful; to send messages to people who have not agreed to receive them; to upload content you have no right to; or to try to break, overload or get around the service's security. We may suspend an account that does, after notice where possible.
8. Availability and changes
We work to keep the service available at all times, but it may occasionally be unavailable for maintenance or for reasons outside our control. We improve the software continuously; if we remove a feature that is part of your plan, we will tell you in advance.
9. Liability
The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential losses such as lost profits or lost business, and our total liability for any claim is limited to the subscription fees you paid us in the three months before the claim arose.
10. Ending the agreement
You may stop using the service at any time. We may end this agreement with 30 days' notice, or at once if you seriously break these terms. When it ends, you can ask for a copy of your data within 30 days.
11. Law and disputes
These terms are governed by the laws of India. Courts in Sindhudurg, Maharashtra have jurisdiction over any dispute. We will always try to resolve a problem with you directly first.
